Please read the following terms and conditions (“GMAS Terms”) carefully before using the GMAS (defined below). If you do not agree to these GMAS Terms, you are not permitted to use the GMAS.

These GMAS Terms must be read as a part of the terms and conditions available at Terms of Use (“T&Cs”) as well as the Privacy Policy available at Privacy Policy (“Privacy Policy”). Undefined capitalised terms used in these GMAS Terms shall have the meaning ascribed to them in the T&Cs.
Please note that the T&Cs shall continue to apply to your use of the GMAS; and these GMAS Terms must be read in addition to the T&Cs.

 

1.DEFINITIONS

 

1.1.“GMAS” or “Get Me A Shop” is a feature that allows you to create an online store to sell your products and services via your own domain name or via the Website (as selected and subscribed by you).

 

1.2.“Platform” shall mean all online portals owned and operated by the Company and located at Instamojo.

 

1.3.“Store” shall mean your online store that you create through the GMAS.

 

1.4.“You/you”, “Your/your” shall mean any natural or legal person who is a registered user of the Platform.

 

1.5.“Website” shall mean Instamojo.

 

2.GMAS FACILITY

 

2.1.Free Version : The Company by default offers you a free version of GMAS, with access to a limited number of features that you can use to customise your Store.

 

2.2. Paid Version :

 

(a) In the event you opt for the paid version of GMAS, you will have the ability to link your Store to your online registered domain name (“Domain”), and integrate the Company’s payment aggregator services to process all payments received on your Store and Domain in one place. The Company may also offer you additional services and features from time to time. Details of these features are available at [https://www.instamojo.com/subscription/]

 

(b) In the event you opt for a paid version of GMAS, you shall be charged a “Fee” based on the type of subscription plan you choose. Such Fee shall be paid in time. Failure to make timely payments will result in termination of the paid features of GMAS. All Fees are exclusive of all applicable taxes.

 

2.3. Use of GMAS : With respect to your use of GMAS, you agree that you shall:

 

(a) not use GMAS for any illegal or unauthorised purpose;

 

(b) not violate applicable law;

 

(c) not transmit any worms or viruses or any code of a destructive nature;

 

(d) comply with these GMAS Terms.

 

2.4. Content on GMAS : All information, data, text, software, music, sound, photographs, graphics, video, messages or other materials (“Content”), that you upload, is your sole responsibility). You warrant and represent that

 

(a) you are the owner of such Content, or that the owner of such Content has granted you a license to use such Content consistent with the manner and purpose of your use and as otherwise permitted by these GMAS Terms,

 

(b) you have the rights necessary to grant the licenses and sublicenses described in the T&Cs, to such Content, and

 

(c) that each person (if applicable) depicted in such Content, if any, has provided consent to the use of the Content. You represent that you have valid rights and title in any and all Content that you upload on your Store, that you have not infringed on any intellectual property rights belonging to any party. You agree and understand that the Company does not pre-screen Content and may, in its sole discretion, refuse or remove any Content that does not comply with the requirements hereunder.

 

2.5. Cancellation of GMAS : You agree and understand that you cannot opt out of or cancel your paid subscription to GMAS until your billing cycle for such paid subscription is completed.

 

3. STORE

 

3.1. Without prejudice to anything detailed here, Section 4 of the T&Cs (Restrictions) shall apply to your use of the GMAS (including but not limited to your activities on or through the Domain).

 

4.DISCLAIMERS

 

4.1. You agree and understand that (a) your use of the GMAS is at your sole risk,

 

(b) the GMAS facility is provided on an “as is” basis, without warranties of any kind from the Company, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that use of the GMAS will be uninterrupted or error-free.
